Official Rules & Eligibility

This contest ends on Thursday, August 14, 2025, at 11:59 PM. The grand prize winner will be randomly drawn and announced on Ocean Prime social media channels on Friday, August 15, 2025. Entrants must be at least 21 years of age or older.

ELIGIBILITY: This Giveaway is offered and open to legal residents of the United States, who are of legal age of majority in Ohio and at least 21 years of age. Associates of Cameron Mitchell Restaurants and advertising and promotion agencies, and each of their respective officers, directors, employees, representatives and agents (collectively, the “Giveaway Entities”), and their immediate families and members of their households, are ineligible to participate in the Giveaway. For the purposes of this section, “immediate family” means spouses, children, parents, siblings, or any members of the same household of any employee or director.

HOW TO ENTER: NO PURCHASE NECESSARY: A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

During the Giveaway Period, entrants must complete their name, telephone number, city of residency, and email address (if available), and accept these Official Rules on the official entry form (the “Oyster Day Entry Form”) made available either online by visiting Ocean-Prime.com (the “Contest Webpage”) from a computer or mobile device during the Giveaway Period. After entrants have supplied their email addresses, Cameron Mitchell Restaurants may contact any entrant with information about VIPrime. The Giveaway Entities assume no responsibility for late, incomplete, incorrect, misaddressed, or misdirected entries. It is the sole responsibility of the entrant to notify CMR if his or her contact information changes. Upon completing an Entry Form, participants will automatically receive one (1) entry into the applicable random drawing. Limit of one (1) submission of Entry Form per person during the Giveaway Period. For simplicity, the Entry Forms shall sometimes hereinafter be referred to as the “Entries.” Entries made between the applicable Entry Start Date and Entry Date are for the subject Drawing only. After the subject Drawing Date, previously submitted Entries shall be discarded and only new Entries submitted subsequent to the applicable Entry Start Date shall be eligible. All Entries become property of CMR and will not be returned to entrants. All Entries must be submitted during the Giveaway Period. CMR will not verify receipt of Entries. Odds of winning vary depending on the number of eligible participants who participate.

RANDOM DRAWINGS: One Prize Winner will be selected. For the Drawing, the Prize Winner will be selected in a random drawing conducted by CMR, through the use of an electronic number generator, among all eligible Entries received according to these Official Rules. The winning Entry will be selected from all the eligible entries received by CMR as set forth below. All Prize Winners will be contacted via email (if provided by entrant on the Entry Form) or by telephone. For promotional purposes, all Prize Winners may also be announced on social media. In no event shall any entrant who has been selected as a Prize Winner for the National Oyster Day Giveaway be selected as a Prize Winner for a different Drawing or Prize during the Giveaway Period for the National Oyster Day Giveaway.

RESTRICTIONS: Entries are valid only on a mutually agreed upon date by CMR and Cape Cod Oyster Co. All other expenses not specifically mentioned herein are each Prize Winner’s and their guest’s responsibility (as applicable). CMR assumes no responsibility for canceled, delayed, suspended, or rescheduled events. If a travel guest is a minor under the age of 18, the Prize Winner must be minor’s parent or legal guardian and must accompany the minor at all times.

GENERAL TERMS: No purchase is necessary, and a purchase will not increase your chances or odds of winning. No substitution of prize is offered; no transfer of prize to a third party is permitted. CMR reserves the right to award a prize of equal or greater value in the event the published prize is unavailable. Void where prohibited or restricted by law. Prize recipients will be solely responsible for paying all applicable federal, state, and local taxes on prizes based upon the final value of the prize as determined by CMR at the conclusion of the Giveaway. Prize Winners will receive an IRS Form 1099 for the full retail value of the prize as set forth in these Official Rules. By participating in this Giveaway, all entrants agree to be bound by these Official Rules and the decisions of CMR and waive any right to claim any ambiguity in the Giveaway or these Official Rules.

WINNER NOTIFICATION/RELEASES: The Prize Winner will be notified within four (4) days of the applicable drawing. Prize Winners will first be notified by email (if provided by entrant on the Entry Form) or via telephone. All prizes must be claimed within three (3) days of notification. If any prize is not claimed within three (3) days of email or telephone notification by CMR to the Prize Winner, the prize may be forfeited, and an alternate winner may be selected; it being agreed to and understood that CMR shall be under no obligation to select an alternate winner.

LIMITATION OF LIABILITY: THE GIVEAWAY AND THE PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

The Giveaway Entities expressly disclaim any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of the prizes awarded. The Giveaway Entities make no representations or warranties concerning the appearance, safety, or performance of any prizes awarded. Restrictions, conditions, and limitations apply. This Giveaway is subject to all applicable federal, state, and local laws. This Giveaway is also void where restricted in a manner not satisfied by the publication of these terms and conditions.

RELEASE AND INDEMNIFICATION: Prize Winner, by acceptance of a prize, agrees to release, discharge, indemnify and hold harmless the Giveaway Entities from any and all liability, claims or actions of any kind whatsoever for injuries, damage or losses, including death, to persons and property which may be sustained in connection with the receipt, ownership or use of the prize or while preparing for, participating in, and/or traveling to any prize-related activity.
